All the details
Who we are
USA Design Engineering LLC, doing business as MechWorks Design Engineering, 7421 35th Ln E, Sarasota, FL 34243, USA, is responsible for your personal data (the controller). Contact: info@mw-de.us, +1 813 724 1812.
What data we collect
Data you send us. When you use a contact form, write to us, call us or contact us on WhatsApp or LinkedIn, we receive your name, company, email address, phone number, the area of interest you select, your message and any files you attach. When we meet at trade fairs or events, we also receive the details on the business card you give us.
Technical data. Like any website, our hosting provider records technical information such as IP address, browser type, pages visited and time of the visit, to keep the site working and secure.
Cookies. The site uses only one technical cookie, to remember your language. Details are in our Cookie Policy.
Required and optional data
In our contact forms, name, email, area of interest and message are required and marked with *: without them we cannot answer you. Company and phone are optional. No law obliges you to give us your data.
Why we use it and on what legal basis
To answer your request and prepare proposals and quotes. If you contact us for yourself, this is a step you ask for before a possible contract (Art. 6(1)(b) GDPR); if you contact us on behalf of a company, it is our legitimate interest in answering business inquiries (Art. 6(1)(f) GDPR).
To carry out the work and manage relationships with clients and suppliers: performance of the contract or, for company contacts, our legitimate interest in managing business relationships.
To keep our business archive: our legitimate interest in keeping the history of our work and contacts.
For invoices and accounting: our legitimate interest in complying with the tax and accounting laws that apply to us in the United States.
For the security of the site (technical data): our legitimate interest in keeping the site safe.
We do not process any data on the basis of consent. You can ask us how we balanced our interests with yours.
We do not sell or share your data
We do not sell your personal data and we do not share it with anyone for marketing or for their own purposes. We do not send newsletters or marketing emails.
Who handles the data for us
Bluehost (Newfold Digital, Inc., USA), which hosts the website and our email; advisers bound by professional secrecy, only when needed (for example for tax matters); public authorities, only when the law requires it.
Where your data is processed
We are based in the United States: when you write to us, you send your data directly to us there. No EU adequacy decision covers us, because we are not certified under the EU-U.S. Data Privacy Framework. Our hosting and email provider processes the data on our behalf, mainly in the United States.
How long we keep it
We keep requests, correspondence and project files in our business archive, because the history of our work and contacts helps us follow our clients over time and serves as a reference for new projects. Invoices and accounting records are kept at least as long as the tax laws that apply to us require. If you want us to delete your data, write to us and we will do so, except for what the law requires us to keep, such as invoices.
Confidential files
Technical files and drawings you send us are treated as confidential and, when requested, are covered by a non-disclosure agreement (NDA).
How we protect it
The site uses an encrypted connection (HTTPS), and access to your data is limited to the people who need it to work with you.
Your rights
You can ask at any time to access your data, correct it, delete it, limit its use or receive it in a portable format, by writing to info@mw-de.us. If you are in the European Union, you can also lodge a complaint with the data protection authority of the country where you live or work: in Italy the Garante per la protezione dei dati personali, in Spain the Agencia Española de Protección de Datos, in Germany the authority of your federal state.
Right to object
Where we rely on our legitimate interest, you can object at any time, for reasons related to your particular situation, by writing to info@mw-de.us. We will stop, unless we have compelling legitimate grounds or need the data to establish, exercise or defend legal claims.
Automated decisions
We do not make automated decisions about you and we do not profile you.
Tracking and California
No third party collects information about your online activity over time and across websites through our site. Because we do not track visitors, Do Not Track and Global Privacy Control signals change nothing. The California Consumer Privacy Act does not apply to a business of our size, but we voluntarily honour requests to know, correct or delete your personal information.
Links to other services
Our WhatsApp and LinkedIn links take you to those services, which follow their own privacy policies. If you message us there, we use what you send as described in this policy.
Children
This site is not directed to children under 16 and we do not knowingly collect their data.
Changes
If we make material changes, we will publish them on this page with a new effective date.
